1. Scope of application, changes to GTC, means of payment

1. The General Terms and Conditions (GTC) govern the legal relationship between ADV HORESPA SARL, Fleurs des Champs 17, 3963 Crans-Montana and its customers. Where the company name ADV HORESPA SARL is used hereinafter, this applies to all reservations for stays and extras both on the www.art-vivre.ch website and in the Art de Vivre hotel.

2. Contract

2.1. By making a booking with ADV HORESPA SARL, you are deemed to have read, understood and accepted these Booking Conditions, our privacy policy and the terms of use of our website. The person making the reservation must be of legal age at the time the reservation is made.

2.2. The person making the booking will be responsible for the administration and correspondence relating to the booking and warrants that he/she is the parent or legal guardian (if applicable) and/or has the authority to make the booking (and any alterations and/or cancellations) on behalf of all persons named on the booking.

The person making the reservation is responsible for :

  •  full payment of all installments and balances;
  •  payment of all change or cancellation fees;
  • to pass on to all persons involved in the booking all information issued by ADV HORESPA SARL, including, without limitation, invoices, booking confirmation and these Booking Conditions; and
  • ensure that we have, at all times, a valid e-mail address and telephone number for the person who made the Booking in case we need to contact you.

2.3. ADV HORESPA SARL reserves the right to reject, cancel or terminate any booking in the event of any breach of the Contract by you, or where there is evidence of fraudulent activity and/or transactions.

3. Make a reservation

3.1 To make a Reservation with us, you must select the room category and dates you wish to reserve and submit a Reservation request to us, together with your credit card numbers (see article 4 (Payments) below), either on our website or by telephoning us on the numbers indicated in article 1 above. We will then send you an e-mail acknowledging receipt of your Reservation request (please note that this e-mail does not yet constitute confirmation of your Reservation with us).

3.2 On receipt of your Booking request, we will check availability and, we will accept your Booking request and send you a Booking confirmation by e-mail, at which point a Contract will be established between you and ADV HORESPA SARL. Please check the information on your booking confirmation carefully and inform us immediately of any incorrect or incomplete information.

4. Payment

4.1 When submitting a Reservation request, you will be asked for your credit card numbers in order to lock the reservation.

4.2. Payment can be made by credit card, cash, twint, bank transfer or gift voucher.

4.3 The gift voucher is valid for one (1) year from the date of purchase and can be used on all ADV HORESPA SARL sales.

4.4. If the balance is not paid on time (you will receive a reminder by e-mail 4 days after the payment due date).

5. Insurance

5.1 We recommend that you take out adequate travel insurance, effective at the date of Booking. You must ensure that your insurance fully covers all your personal requirements, including, without limitation, full Covid-19 cover, personal effects, any pre-existing medical conditions, cancellation costs, medical expenses and repatriation costs in the event of accident or illness.

5.2 When you make a Reservation with ADV HORESPA SARL, no cancellation insurance is taken out; this service is not offered by ADV HORESPA SARL.

6. Awards

6.1. We endeavour to ensure the accuracy of all information and prices on our website and in other promotional material. However, changes and errors may occasionally occur and we reserve the right to correct prices and other details in such circumstances and at any time. You must check the current price and all other details relating to the room category you wish to book before making your Reservation. If a price shown on our Booking confirmation, website or promotional material is manifestly incorrect, i.e. the price is derisory, a Booking made on the basis of that price will not be valid and we reserve the right to cancel the Booking unless you wish to pay the correct price.

6.2. We reserve the right to change the prices shown on our website at any time before you make a booking with ADV HORESPA SARL.

6.3. Prices are quoted - and will be payable - in Swiss Francs and the price will include all taxes, with the exception of applicable tourist taxes which will be payable per person per night, at the time of check-out.

6.4. We shall not be liable for any Booking errors for which you are responsible.

6.5. Special offers and/or discounts that may become available after you have made a Reservation with ADV HORESPA SARL cannot be applied retroactively to your existing Reservation(s).

7. Reservation cancellation

7.1. You may cancel your Reservation at any time by contacting ADV HORESPA SARL using the contact methods mentioned in article 1.1.

7.2. In the event that you cancel your Reservation, the following cancellation charges will apply:

  • More than 15 days before the first day of booking: 0% of the total booking price
  • 14days - 7days: 50% of the total booking price
  • 6days - 1day: 80% of the total booking price
  • -24hours - NoShow: 100% of the total booking price

7.3. If you have booked more than one room with ADV HORESPA SARL, cancellation charges will only apply to the room cancelled.

8. Reservation modification

8.1 If you wish to change your booking in any way, for example your arrival date or room category, ADV HORESPA SARL will do its utmost to make such changes, but this will not always be possible. Any request to change your booking must be made in writing to the contact mentioned in article 1.1 and the effective date of any change will be the date on which we receive the written notification.

9. Exceptional and unavoidable circumstances

Unless expressly stated otherwise in these Booking Conditions, we will not be liable for any damages, losses, costs or other expenses incurred by you - and we will not pay you any compensation - where the performance or prompt performance of our contractual obligations to you is prevented or affected - or you suffer damages, losses or expenses of any kind - as a result of exceptional and unavoidable circumstances. Exceptional and unavoidable circumstances are events that neither we nor the suppliers of the service(s) in question could, even by exercising all due diligence, foresee or avoid and include, without limitation: war (whether actual or threatened), civil unrest, riots, conflicts, terrorist activities and/or their consequences or the threat of such activities, health hazards, infectious diseases, epidemics and pandemics and government measures to combat such epidemics, riots, the act of any government or other national or local authority, or the act of any airport, port or river authority, unforeseeable technical problems in transport, restriction of closure or congestion of airports, ports or airspace; flight or other travel restrictions imposed by any government, regulatory authority or other third party; labor disputes, sanctions, closure of locks, natural or nuclear disasters, fires, floods, adverse weather conditions, volcanic eruptions, chemical or biological disasters and all similar events beyond our control or that of the supplier concerned.

10. Behavior

10.1 If your behaviour or that of a member of your Booking causes or is likely to cause danger or harm to third parties (any other traveller, our staff or agents or that of service providers and/or partners) or damage to property, we reserve the right to consider that your Booking has been cancelled by you with immediate effect. In this case, our liability to you will cease and you and the persons referred to in your Booking will be required to vacate the room immediately. Our obligations to you and/or the persons referred to in your Booking will cease immediately and we will not be liable for any damages, losses, refunds, expenses or other costs incurred by you as a result, including, but not limited to, any return travel arrangements, costs of cleaning, repairing or replacing property lost, damaged or destroyed by you, or compensation to any supplier or agent affected by your actions.

10.2 If you cause damage to the room in which you are staying, you must fully reimburse ADV HORESPA SARL for the cost of the damage before the end of your stay (if the cost has already been established) or as soon as the cost has been established (if established later). You must also indemnify us for the full amount of any claim (including any legal costs) made against us or any third party as a result. We cannot be held responsible for the actions or behaviour of other guests or persons who have no connection with your Booking or ADV HORESPA SARL.

10.3. The person who made the Reservation and any adult accompanying the group must, at all times :

  • (i) act reasonably for their group and, in particular, with respect to minors in the group;
  • (ii) ensure that the group takes into account their personal safety while at their destination, so as not to expose themselves or others to unnecessary risks, including, but not limited to, not putting themselves in risky situations; are not intoxicated or under the influence of any other illegal or dangerous substance, and in any case do not allow anyone under the age of 18 to consume alcohol; and are aware of their behavior and actions in the context of their environment;
  • (iii) ensure that no member of the group smokes in non-smoking areas or behaves in any other way that could lead to a fire hazard;
  • (iv) ensure that the Group or any member of the Group complies with all relevant laws.

11. Special requests

Any special requests must be communicated to us at the time of Booking. While we will do our best to accommodate reasonable special requests, we cannot guarantee that they will be met and failure to accommodate a special request on our part will not be considered a breach of our Contract with you. The fact that a special request has been noted on your Booking confirmation or other document does not constitute confirmation that such request will be fulfilled.

12. Groups

12.1. The following booking conditions apply to all groups:

  • Deposit of 50% of the total booking amount to be paid on confirmation of booking either by providing credit card number and expiry date or to ADV HORESPA SARL's bank account.
  • The definitive rooming-list must be provided no later than 14 days before the group's arrival.
  • The balance must be paid on departure.

12.2. For all groups, the following cancellation conditions apply:

  • More than 30 days before the first day of booking: 0% of the total booking price
  • 30 days - 15 days: 50% of the total booking price
  • 14days - 8days: 80% of the total booking price
  • 7 days - NoShow: 100% of the total booking price

13. Liability

13.1. Use of ADV HORESPA SARL's facilities, in particular the use of training equipment, is at the user's own risk. Insofar as permitted by law, ADV HORESPA SARL cannot be held liable for direct or indirect damage. The customer is responsible for taking out insurance.

13.2. ADV HORESPA SARL accepts no responsibility for the loss of personal belongings, valuables, money, clothing, membership cards, etc., nor for any items left at reception, in the cloakroom or in the children's area. ADV HORESPA SARL also accepts no responsibility for items left at reception, in the checkroom or in the children's area.

14. Monitoring

The customer declares that he/she is aware of and agrees that certain areas of the ADV HORESPA SARL establishment may be monitored by cameras to ensure qualitop certification and for protection and security reasons. The changing rooms and washrooms will not be monitored by cameras.

15. Data protection

The processing of personal data in connection with ADV HORESPA SARL contracts is subject to the establishment's data protection declaration. The data protection declaration explains how the facility processes personal data, in particular in connection with ADV HORESPA SARL membership contracts, and in particular contains information on the purpose for which personal data will be processed, whether it will be passed on within the ADV HORESPA SARL facility, and what rights the data subjects have in relation to their personal data.

16. Applicable law and place of jurisdiction

These General Terms and Conditions and any membership contracts concluded in accordance with them are subject exclusively to Swiss substantive law. The place of jurisdiction is Sierre (VS).
